Judge will decide on Friday if convicted rapist Cory Batey gets new trial

A judge will decide on Friday if Cory Batey will receive a new trial in the Vanderbilt rape case.

During the retrial, Batey was convicted of rape an unconscious woman in a dorm room. A jury convicted him on charges of aggravated rape, three counts of aggravated sexual battery, facilitation of aggravated rape and two counts attempted aggravated rape. He was sentenced to 15 years.

Batey's attorney cited language in the charges and instructions given to jurors when arguing Batey's case for a new trial.

Now, the former Vanderbilt football player will know by the end of the week if he'll get a new trial.
