DesJarlais-Tracy Race Remains Undecided -- Sky Arnold

MURFREESBORO, Tenn -- One of the biggest elections this week remains unsettled.

There are only  35 votes separating Congressman Scott DesJarlais and his opponent State Senator Jim Tracy.

Friday DesJarlais claimed victory while Tracy refused to concede.

His campaign told Fox 17 News provisional ballots remain a key question mark.

Tracy's campaign believes there could be 100 of them uncounted in the 16 counties that make up the 4th Congressional district.

They're cast by people who either didn't have a photo ID or there's a question about their registration.

Voters who cast a provisional ballot without a photo ID have until the end of business Monday to show that ID to election officials in their county.

As of Friday evening only one of the 5 voters who voted this way in Rutherford County had come forward.

It also remains to be seen how many of those provisional ballots actually involve a vote in the 4th District race because they could include votes from the Democratic party primary.

That's one reason why Desjarlais believes the provisional ballots won't impact the current result.

"There's probably less than 100 out there.  There's a fair number that are Democrats and we're gonna get our fair share.  I assume so I don't think it's enough to move that number," said Desjarlais.

If there are any signs of voting problems it's possible these provisional ballots won't settle the race.

The losing candidate has the option of appealing to the Republican State Party Executive Committee.

That group of party leaders would then hear the evidence and decide for themselves who won the race.
