Contractor Accused of Assault Requests Order of Protection Against Ex -- Erika Lathon

Stream WZTV Fox 17 Newscasts LIVE starting with Fox 17 This Morning at 4:30am and News at 9pm.

A Nashville contractor who is accused of assaulting his ex-girlfriend twice sought to get an order of protection against her on Wednesday.

David Chase contends he was harassed by his ex-girlfriend and that she assaulted him the night he was arrested for domestic assault.

The case caused controversy because the judge Chase went before after the first arrest waived a 12-hour cooling off period for him. Judge Casey Moreland was accused of being influenced after photos on Facebook emerged him vacationing with Chase's attorney, seeming to show a close friendship between the two men.

On Wednesday, Chase's attorney argued that prior to the alleged assault in early June, the couple had broken up but Chase's ex-girlfriend refused to leave his apartment and began sending harassing text messages.

A digital forensics expert who analyzed Chase's cell phone read some of the text messages. More than 189 text messages were entered into evidence, outlining what appeared to be a volatile relationship.

The hearing on Chase's order protection will be continued on August 18. The alleged assault victim already has an order of protection against Chase.
