Kroger Customer Complains of Sell By Product Dates -- Meagan O'Halloran

HERMITAGE- One local woman is going after the nations largest grocery retailer and accusing them of selling products past its sell by date. Carrie Lynn gave Fox 17 documented pictures she claimed to have taken inside the grocery store that shows salad, desserts, and meat being sold on the shelf after its suggested sell by date. Lynn claims she found pre-packaged taco kits on sale up to five weeks past the sell date.

The Metro Health Department says the grocery store didnt break any rules. Brian Todd, a spokesman for the Health Department said the suggested sell by dates you see on food is not regulated or required and serves only as a customer courtesy. The Health Department adds it conducts unannounced bi-annual food inspections at all area grocery stores and restaurants. Todd did not believe Kroger had any violations when it comes to health department checks.

A spokeswoman from Kroger released this statement Monday.

"Food Safety is certainly something we take very seriously at Kroger.    Our associates are trained on proper rotation, and part of that training includes checking for dates that are close to expiration numerous times each day.    We put great emphasis on the quality and freshness of the products we sell  and certainly the sell by dates help us ensure that.   We take any issues in regards to freshness seriously, and are already in the process of addressing these concerns with the store in question. "
