Renter Refuses to Pay Landlord For Unsafe Portland Home--Mikayla Lewis

PORTLAND, Tennessee-- A Sumner County woman is refusing to pay her $500 rent to her landlord because she says her home is unsafe.

Karrion Carter moved in the home with her husband and two grandsons last November. In just a few months, Carter says she fell ill to pneumonia twice and her family gets sick as well. Carter's family heirlooms, cherished photos and 80 percent of her clothes has been consumed with mold.

Carter said, " They cannot be replaced, destroyed."

Larry Bandy owns the home Carter is renting on the 300 block of Russell. Bandy owns several rental homes in the area. Karrion's niece lived in one of those homes, but a wall heater destroyed the house a couple of months ago. Before Karrion moved in the home she says she asked the landlord if the house was safe.

Carter explained , " I asked point blank because I have problems breathing  if there was any mold in this house, and he told that he just done spending $600 fixing up this house."

Carter says Bandy painted over the mold before she moved in, and the paint is now chipping away exposing the massive amounts of black mold. The house also has exposed wires, heating problems, a hole in the ceiling from a leaky roof, and the weak foundation is severely shifted throughout the only level of the house.

Carter said, " I ain't got no problem paying my rent, but I don't deserve to live in this crap either. "

According to the Tennessee Landlord Tenant Act, :

Tennessee Code Annotated Title 66 Chapter 28 contains the Uniform Residential Landlord and Tenant Act.  It states the landlord shall:

  1. Comply with requirements of applicable building and housing codes materially
    affecting health and safety;
  2. Make all repairs and do whatever is necessary to put and keep the premises
    in a fit and habitable condition;
  3. Keep all common areas of the premises in a clean and safe condition; and
  4. In multi-unit complexes of four (4) or more units, provide and maintain appropriate receptacles and conveniences for the removal of ashes, garbage, rubbish and other waste from common points of collection subject to 66-28-401(3).

Fox 17 called Larry Bandy this afternoon, who says it is Carter's responsibility to repair the home. He says he will fix the house is she moves out.

Larry Bandy said, " I think she needs to move and I could rent that house to somebody else tomorrow. She's just trouble I keep telling you, she's just trouble."

"Slumlord, because he does not care about anything but the money, " said Carter.

Carter is planning to seek help from her local codes department this week. According to the Sumner County Sheriff's Office, Bandy has been in trouble with the law for assault and animal cruelty in the past.
