NASHVILLE, Tenn.-- Vanderbilt rape suspect and former football player Cory Batey will have to wait a little longer for freedom.

Batey appeared in court Tuesday morning asking that an ankle monitoring device be removed. The judge will take it under advisement in the next 30 days.

Batey has not been in any trouble since released from jail for charges of rape and sexual battery in a June incident in a campus dorm.

Batey is the only one of the suspects in the case that is from Nashville and made to wear the device.

The defendant has  to pay a 400 dollar monthly fee to wear the device.
An August trial date is set in the case.
