EXCLUSIVE: Major Developments in Rape Case Involving Former Vanderbilt Football Players

NASHVILLE, Tenn. - FOX17 has learned that 2 of the suspects in the Vanderbilt rape case will testify for the state against the other 2. It's all part of a decision to separate their cases. Attorney Mark Scruggs tells FOX17 at a hearing before Criminal Court Judge Monty Watkins tomorrow morning, former players Brandon Banks and Jaborian "Tip" McKenzie will have their cases severed from Cory Batey and Brandon Vandenburg. Scruggs, who represents Banks, stresses this is not a plea deal. Banks and McKenzie will eventually testify for the state. The District Attorney's Office will not confirm these new developments. Banks, McKenzie, Vandenburg and Batey are charged with raping an unconscious female student in a dorm room last June. FOX17 NEWS has learned visual evidence in the case is strong. This action could impact further action in this high profile case. Sources close to the case tell us a trial date in May 2014 will be set for Cory Batey and Vandenburg.
