Sparking debate this morning, the Massachusetts Supreme Court rules that it is not illegal to take a picture up a woman's skirt.

The practice is called "upskirting."

This ruling comes in the case of man who was charged twice with taking these kinds of photos of women on the MBTA green line.

It may seem creepy, but the court explained the practice does not violate the so-called "Peeping Tom" statue. The 10-year-old law says it is only illegal if the person is nude or partially nude.

The high court believes the photos are wrong, but says its hands are tied because of the law.

The district attorney says the law needs to rewritten
