Prosecutors have decided not to prosecute a man accused of trespassing on property owned by singer Taylor Swift.
24 year old Jacob Kulke has been in the Metro Jail since his arrest on December 13th.
Police have said Kulke scaled a secured gate and fence outside the home on Harding Place. According to the arrest warrant, he wanted to surprise her on her birthday.
Prosecutors declined to pursue a trial in part because Kulke has already served jail time consistent with the misdemeanor trespassing charge.
Kulke still faces a probation violation charge in Colorado, and he is being held in Tennessee as a fugitive from justice.
He is fighting extradition to Colorado and will have another hearing in Nashville on January 29th.
Kulke remains in the Metro Jail on a $350,000 bond because of the Colorado case.

Witness rescues toddler from railroad tracks
June 19, 2013 11:23 GMT
ROCKWOOD, Tenn. (AP) -- Authorities have arrested the parents of a toddler found alone on railroad tracks in Rockwood.
The Knoxville News Sentinel (http://bit.ly/1asg9U3 ) cited an officer's report which said a witness saw the 2-year-old on the rails and picked him up shortly before a train came through the town on Saturday.
Jonathan Noah White, who is 30, and 24-year-old Rahab Jaramillo were arrested and booked into the Roane County Jail on charges of aggravated child abuse and neglect.
The incident report states the child's grandmother told police the boy was often left with her, but she was on "too many medications" to watch him. The boy was put into Department of Children's Services custody.
