      <title><![CDATA[Judge rules for cheerleaders in Bible banner suit]]></title>

      <description><![CDATA[HOUSTON (AP) - A judge ruled Wednesday that cheerleaders at a Southeast Texas high school can display banners emblazoned with Bible verses at football games.<p>But the ruling might not have settled the issue of whether the banners are protected free speech, according to an attorney for the cheerleaders' school district.</p><p>State District Judge Steven Thomas determined the Kountze High School cheerleaders' banners are constitutionally permissible. In the ruling, Thomas determined that no law "prohibits cheerleaders from using religious-themed banners at school sporting events."</p><p>The Kountze school district had initially said the banners could not be displayed after receiving a complaint about them in September from the Freedom From Religion Foundation. The foundation argued the banners violated the so-called First Amendment Establishment Clause that bars government - or publicly funded school districts in this case - from establishing or endorsing a religion.</p><p>Thomas ruled that the establishment clause does not prohibit the use of such religious-themed banners at school sporting events.</p><p>"This is a great victory for the cheerleaders and now they're going to be able to have their banners," said Hiram Sasser, a lead attorney for the Liberty Institute, a Plano, Texas-based nonprofit law firm that represented the cheerleaders.</p><p>But Thomas Brandt, the school district's attorney, argued that Judge Thomas also granted a school district motion in his ruling that says the district can permit the banners under the establishment clause but is not required to do so. Brandt said the motion also says the banners are the speech of the school, not private speech, so the school has a right to have editorial control of the banners.</p><p>Initially, the school district ruled the banners could not be displayed. But after a public meeting in February, the school board of trustees issued a resolution in which it wrote that the district was not required to prohibit messages on school banners that displayed "fleeting expressions of community sentiment solely because the source or origin of such messages is religious." But the trustees said the district retained the right to restrict the content of school banners.</p><p>Brandt said while he has yet to talk to the school district about whether or not it will appeal, it may seek some clarification from the judge on his ruling.</p><p>But Sasser said there is no ambiguity in the ruling and that the banners are the cheerleaders' protected private speech.</p><p>"We won and they didn't," he said, adding that he expects the school district to appeal.</p><p>The dispute began during the last football season when the district barred cheerleaders from using run-through banners that displayed religious messages, such as "If God is for us, who can be against us."</p><p>In October, Thomas temporarily allowed the cheerleaders to continue displaying the banners pending the lawsuit's outcome. Thomas at the time said the school district's ban on the practice appeared to violate the students' free speech rights. The Liberty Institute had argued the banners' messages were not asking anyone to believe in Christianity or accept the faith.</p><p>The cheerleaders in Kountze, located about 95 miles northeast of Houston, were supported by various state officials, including Gov. Rick Perry and Texas Attorney General Greg Abbott, who filed court papers seeking to intervene on their behalf. A Facebook group created after the ban, Support Kountze Kids Faith, has more than 45,000 members.</p><p>Abbott praised the court's ruling on Wednesday, calling it a "victory for religious liberties."</p><p>Perry in a statement said the cheerleaders "showed great resolve and maturity beyond their years in standing up for their beliefs and constitutional rights."</p><p>The Freedom From Religion Foundation's co-president, Annie Laurie Gaylor, was disappointed with the ruling, saying the banners "carry the appearance of school endorsement and favoritism, turning Christians into insiders and non-Christians and nonbelievers into outsiders."</p><p>The Anti-Defamation League also criticized the ruling, calling it "misguided" and saying it "flies in the face of clear U.S. Supreme Court and other rulings."</p><p>Attorneys for the Kountze school district, in initially advising the superintendent to ban the religious statements on the cheerleaders' banners, argued there have been several precedent-setting rulings by the Supreme Court.</p><p>In 1 of the more well-known cases, the court ruled in 2000 that a practice of allowing student-led prayer ahead of high school football games in Texas' Santa Fe Independent School District violated the Constitution.       <description><![CDATA[Kid President -- Fox 17 Nashville Exclusive by Nick Paranjape<br><br>If you heard the name Robby Novak, you probably wouldn't recognize it.&nbsp; If you heard Kid President, chances are better you know exactly who that is.&nbsp; The 9-year-old from west TN has been a huge hit on YouTube from his witty skits to meeting the *real* president.&nbsp; Only on Fox, we sat down with this funny 3rd grader who's got a serious message all while battling a rare disorder.<br><br>In his videos, you see him in his black suit and red tie with that contagious laugh and always seems to be dancing.&nbsp; But there is a serious message from Robby Novak, otherwise known as Kid President.&nbsp; "It just matters if you're nice to everyone" says Novak.&nbsp; That's just one of his messages from his YouTube video "Pep Talk" which has more than 22 million views.&nbsp; He encourages kids to make the world less boring.<br><br>The concept of Kid President was the brain child of his brother-in-law Brad Montague who was promoting an event at Freed-Hardeman University in Henderson, TN where he works.&nbsp; The next thing he and Robby knew, the videos went viral!&nbsp;&nbsp; Kid President became famous, although his friends are quick to bring him down to earth saying "my friends don't really care that I have fame and stuff".&nbsp; <br><br>Since being in the spotlight, Kid President has been all over the country from Hollywood to D.C.&nbsp; His biggest thrill was meeting the real president.&nbsp; President Barack Obama invited Novak to the oval office.&nbsp; " "it was really fun meeting the president, it was an honor" says Novak.&nbsp; The President told him to keep doing what he's doing and Robby is taking his advice speaking to kids all over the country to make this world a better place.&nbsp; <br><br>One of his regular stops is at Vanderbilt Children's Hospital in Nashville.&nbsp; He doesn't come to entertain the kids, he comes as a patient.&nbsp; Novak suffers from a rare bone disorder called Osteogenesis Imperfecta also known as Brittle Bone Syndrome.&nbsp; In his nine years, he's had more than 70 broken bones!&nbsp;&nbsp; <br><br>Dr. Jill Simmons, a pediatric endocrinologist at Vandy, says Robby's had a great attitude in spite of some significant pain and lots of surgeries.&nbsp; Obviously, Robby is banned from playing sports and although his adoptive parents Laurie and David Novak are protective, they want to make sure he can still be a kid and that includes allowing Robby to wrestle around with his big sister Alexia who also has the same bone disorder.&nbsp; <br><br>Every 13 weeks, Robby comes to Vanderbilt Children's to get an intravenous infusion, a 5-hour long process to make his bones stronger.&nbsp; "the infusions do a great job at decreasing fracture rate, decreasing bone pain" says Dr. Simmons.<br><br>The prognosis for Robby and his sister is excellent according to Dr. Simmons.&nbsp; Both understand what they can and can't do.&nbsp; So, if Robby wants to be president someday, he can!&nbsp; But does he want to?&nbsp; "Nah, too much paperwork" says Novak.<br><br>His brother-in-law, Brad says what's inspiring about Robby isn't his bone condition, but the fact that his condition doesn't define who he is.&nbsp; Just recently, the Kid President team was given the "Making Kids Count Media Award" by the Tennessee Commission on Children and Youth.<br>&nbsp; <br>]]></description>

<P>The CDC now estimates as many as one-in-nine babies are born prematurely in the United States everyday.</P>
<P>Tristar Stonecrest Medical Center has identified the need and on Monday opened the hospital's very first Neonatal Intensive Care Unit. Before the facility opened some preemies had to be transferred to other hospitals to get more critical medical care. Now 80% of those preemies who would have been transferred can now stay at the hospital which will keep the mother and her infant together after the birth.</P>
<P>The Level II Nursery features eight beds and is operated by board-certified neonatologists, nurse practitioners, respiratory therapists and other specially trained healthcare professionals to care for babies born as small as 3lbs.<BR></P>]]></description>

      <description><![CDATA[A Rutherford County Adult Detention Center deputy is terminated for for allegedly bringing contraband into the jail and for conducting himself in a manner unbecoming to an officer<br>Deputy Keith Knowles was terminated after he allegedly brought marijuana, tobacco and a cell phone to inmates during the past month, says Rutherford County Sheriff Robert Arnold.<br>Knowles was terminated May 10. He joined the sheriff’s office as a detention officer June 23, 2008.<br>The sheriff’s office received information this month an officer brought a cell phone and tobacco to inmates. An investigation was immediately launched. Information about the operation was delayed until today while an investigation was conducted.<br>More than 800 inmates and their living areas and pods were searched for contraband. The search resulted in some cigarettes and tobacco, items not allowed in the jail.<br>The sheriff calls the incident "very disappointing."<br><br>PICTURED: Cpl.       <description><![CDATA[Burglars robbed an auto parts store in north Nashville, while another auto parts store in south Nashville is vandalized.<br>Metro Police responded to O'Reilly's at 801 Monroe Street to find someone had made entrance into the business early Wednesday morning by busting out the window. Merchandise was taken.<br>Late Tuesday night, police reported a busted window at the AutoZone at 2340 Murfreesboro Pike. Nothing was taken.<br>Police do not know if there is any connection between the robbery and the vandalism.<br>Surveillance video was taken at O'Reilly's, but is unavailable at this time.<br>Anyone with information is asked to call police at 862-8600.]]></description>

      <title><![CDATA[Story Behind The Song: Merry Go Round - Stacy McCloud]]></title>

      <description><![CDATA[NASHVILLE, Tenn -- The story behind the Kacey Musgraves hit "Merry Go Round" is about as real as it gets.<br><br>Kacey is from a small town and has lived the lyrics she wrote about. So has her co-writers Shane McAnally and Josh Osborne. "It's&nbsp; a singer songwriter approach to a commercial song" says McAnally.<br><br>It was at a 4th of July picnic in Shanes small Texas hometown that the idea for the song came about when someone asked Shane's mom about what the neighbors were up to. "The guy asked Shane's mom about the traffic at the Neighbors house and Shane's mom jokingly said they are selling Mary Kay or Mary Jane or something I don't know what she is doing over there. When she said that,&nbsp; I looked at Shane and told him there was a song there" says Josh Osborne.<br><br>The two were in Texas for a writing retreat for Kacey Musgraves. They went to eat at a diner, ironically named Mary's and started talking about how they could really be onto something. They told Kacey their idea later that day. She loved it and they immediately started pulling inspiration from their own small towns. "People do what their parents did and for a lot of people that is great, but it wasn't for us" says Shane.<br><br>The guys started thinking about the word merry and all it's meanings<br>and started applying them to small town life. "We had the line same hurt in every heart and I said what about same trailer different park" says Josh.<br><br>The only challenge they really had was figuring out how many times they could use the world merry without sounding over the top. They also wanted to make sure people knew that the song isn't an an anti small town song, rather an anti small mind song. "It's not about&nbsp; judgment it's a snapshot of what small town life is" says Josh.<br><br>When the three were finished they knew they had something good, but it wasn't until other writers on the retreat gave their overly positive feedback that they knew they had something great. The song didn't change much from the Texas writing session to the Nashville studio were Kacey recorded it, except she&nbsp; did come up with the lick that in the end Shane and Josh say made the song come to life.<br><br>Merry Go Round never made it to the top of the charts, but Shane and Josh say it's just one of those songs that defines why they are so in love with what they do. "It's the reason we moved here and we stay here. Songs like these happen very rarely."<br>]]></description>

      <title><![CDATA[Fox 17 Helps Storage Unit Renter - Erika Kurre]]></title>

<P>A clash between a property manager and a renter at&nbsp;A-plus Storage&nbsp;in Gallatin has the renter crying foul.</P>
<P>He says his rent was doubled and he was forced to move out with very little warning.</P>
<P>That is, until Fox 17 stepped in to help.</P><FONT size=2>
<P></FONT><FONT size=2>Jason Black is moving out of unit 210 at&nbsp;A-plus Storage&nbsp;where he'd been renting in Gallatin since August 2012.</P>
<P>His lease charges him $74.50 a month, automatically withdrawn from his checking account.</P>
<P>But last month, double the payment was taken.</P></FONT><FONT color=#0004ff size=2><FONT color=#0004ff size=2>
<P></FONT></FONT><FONT size=2>Black says, "It's extremely unethical. Nowhere in that contract does it say a rent increase of 100% should be expected."</P>
<P>Black says when he questioned the property manager, the manager became rude and hostile.</P>
<P>Attorney Jim Higgins says a raise in a month-to-month rent-- no matter how high-- is likely not illegal.</P></FONT><FONT size=2>
<P>But what made Black more nervous than anything was what happened with the property manager during a visit to the storage unit last week.</P>
<P>Black says, "He gets off his cart and comes to me hostily like he's ready for a confrontation. This is unprofessional, there's no reason for it, no one ever approached him, no one started screaming and yelling at him."</P>
<P>The property manager reportedly threatened to evict him and not allow him to access his belongings.</P>
<P>Fox 17 visited the property ourselves Saturday and left a voicemail for&nbsp;the manager&nbsp;when no one answered the door.</P>
<P>We've learned just days after making that call, that manager no longer has a job there and the storage facility has contacted Black to refund his money.</P><FONT size=2>
<P>A-plus&nbsp;Storage tells Fox 17 they've also offered to reduce Jason's rent to its original amount if he stays.</P>

In a Fox 17 special report, we pointed out the Humane Society of the U.S. primarily lobbies for legislation to protect animals and helps in large scale rescues.&nbsp; We also reported that it is not set up to fund local shelters.&nbsp; Now, we take a closer look at how three charity watchdog groups rate the HSUS.&nbsp; About four thousand animals make their way through the&nbsp; Nashville Humane Association each year.&nbsp; A no kill
shelter, in a state that euthanizes more than 7 thousand animals a year.&nbsp;
Though the national organization, the Humane Society of the United States, doesn't fund local shelters like this one, Joy Beach with the Nashville Humane Association says HSUS&nbsp; has
an enormous amount of resources and expertise and equipment that no other
shelter does.&nbsp; She says, when there's a major issue, HSUS&nbsp; brings in their resources, expertise and equipment to help&nbsp; out. </p>

<p class="MsoNormal" style="text-autospace:none">&nbsp; HSUS is the
nation's largest animal protection organization and tax records show, it took in $133 million dollars in
2011.&nbsp; So how do Charity Navigator, Charity Watch and the Better Business
Bureau rate HSUS? </p>

Charity Navigator gives HSUS four stars overall and three in the financial category.&nbsp;&nbsp;&nbsp; It's a designation HSUS CEO and President Wayne Pacelle is proud
of.&nbsp; <br></p>

<p class="MsoNormal" style="text-autospace:none">&nbsp; However,&nbsp; Charity
Watch paints a much different picture, giving HSUS a D noting the animal protection group gives
about half their budget toward actual charitable programs.&nbsp;&nbsp; Daniel Borochoff with Charity Watch says, "We think groups ought to give 60%. The better groups give 75% or
more of their money towards charitable programs." <br></p>

<p class="MsoNormal" style="text-autospace:none">&nbsp;&nbsp;
Charity Watch says its evaluation process is more in depth than any other
charity watchdog group and says a lot of the money HSUS claims is being spent on programs is actually fundraising solicitations.&nbsp; He says they bundle educational material with solicitations for money.&nbsp; Then, HSUS mails it to your house and classifies that as a program that helps animals rather than classifying it as a fundraising expense.</p>Pacelle with HSUS says, "They do a very narrow sort of metric on evaluating finances.
Anybody can call themselves a charity watchdog group, but the main charity
monitoring groups are the BBB &amp;&nbsp; Charity Navigator."

<p class="MsoNormal" style="text-autospace:none">&nbsp; Charity
Watch has been an independent charity rater for 21 years. Yes, Pacelle is correct, the BBB says HSUS meets the
standards of an accredited BBB charity.&nbsp; </p>

<p class="MsoNormal" style="text-autospace:none">&nbsp;&nbsp;&nbsp;&nbsp; One
of its tangible programs is an Animal Expo held in Nashville this month which
attracted more than 2 thousand animal welfare advocates.&nbsp;&nbsp; Charity
Watch says more spending like this on direct animal welfare would go a long way
toward improving its charity rating.&nbsp; </p>

      <title><![CDATA[Schools Try to Be Prepared for Tornados - John Dunn]]></title>

      <description><![CDATA[<p>A heartbreaking part of the Oklahoma tornado is hearing about the deaths of children. Several kids were killed inside their school. It's drawing attention to safety in our own school buildings. </p>
<p>The people at <a target="_blank" href="http://www.nationalstormshelter.com/">National Storm Shelters</a> in Smyrna are in the business of saving lives. Jeff Turner's company sells steel shelters for homes, but he is also familiar with construction techniques that make buildings stronger -- buildings like your child's school.</p>
<p>"A cinder block wall filled with concrete and rebar, but not only that, but bricked on both sides.&nbsp; (Those walls) will withstand 100, 150, 200 mph projectiles," says Jeff Turner with National Storm Shelters.</p>
<p>Strong walls with no windows often provide the best protection in schools. Metro consults with architects to find safe areas, and students have tornado drills at least twice a year. Rooms like gymnasiums should be avoided because they are large open spaces. While building a giant safe room may be impractical, basements are always a good option. FEMA also helps provide funding for community storm shelters.</p>
<p>Metro School leaders say masonry construction offers strong protection. "You are going to be safer inside than outside, and safer in a school than in most homes.&nbsp; We really want to keep these (children) safe and in school," says Meredith Libbey with MNPS.</p>
<p>Regardless if it's a storm shelter or a strong hallway, Oklahoma's tornado offers everyone a lesson -- that it's best to be prepared. Metro School leaders say many parents may be tempted to pick up their children during a tornado warning, but the school policy is to keep children inside the building until the warning has passed.</p>

      <description><![CDATA[A father was arrested for leaving two very young children in a hot car in south Nashville.<br>Metro Police say they arrested Tranquilino Camaja-Lajom, 35, Monday morning after he says he left his 2-and-3-year-old children in the car in a parking lot at 12th Ave. South and Laurel Street for 15 minutes to check on a job. A passerby alerted police at 9:15 a.m.&nbsp; <br>According to the report, the complaintant relayed to police that the windows were rolled up and the vehicle was not in the shade, before rolling the opening the doors. The keys were observed to be in the car, but it was not running.<br>Police say that the children appeared to be a little sweaty when they arrived and were only on scene a few minutes before their father arrived back at the car. They said it was approximately 80 degrees.<br>A witness told police that Camaja had been at the location since 8:45 and was watching an orientation video until approximately 9:25 a.m., giving police reason to believe that the children were unattended for 40-45 minutes.<br>DCS was notified. The children were turned over to their mother.<br>Camaja is in Davidson County Jail on a $25,000 bond for Child Neglect.]]></description>

      <description><![CDATA[Over 1,200 NES customers in west Nashville lost power after a truck took out a power pole. The accident occurred just before 11 p.m. on Monday at White Bridge Pike at Oakmont Circle. <br>The road was shut down at White Bridge Pk. at Corbett Lane into the morning as the wreck was cleared and NES made repairs to restore power.&nbsp; <br>According to Metro Police, Scott Hamrick, 27, was arrested for DUI after he indicated to them that he took several different medications, some not prescribed. <br>FOX 17 News learned from police at the scene that he fell asleep at the wheel before crashing into the pole.       <description><![CDATA[A truck driver was arrested near the Texas/Mexico border for a murder at a hotel in east Nashville this month.<br>Deputy United States marshals and Texas state troopers Monday night arrested over-the-road truck driver, Eric Lozano, 31, Lyford, Tx. He's accused of the murder of Mitchel T. Moreno at the Cumberland Inn at 150 W. Trinity Lane on May 9.<br>East Precinct detectives used surveillance video from the motel and a nearby truck stop to identify Lozano as the suspect in Moreno’s death. An arrest warrant charging Lozano with criminal homicide was issued on May 15.<br>Moreno, 52, of Denmark, Tenn., died from blunt force trauma during an apparent struggle inside his motel room. The motive for Moreno’s murder remains under investigation.&nbsp; <br>Lozano will be returned to Nashville within the next several days, unless he waives extradition.<br><br>Pictured: Eric Lozano]]></description>

      <description><![CDATA[A Portland third grader was caught recording inappropriate cell phone video of herself and then showing it to other kids on the school bus Friday.<br><br>Legally, the 8-year-old could be charged with possession and distribution of child pornography, but Portland's police chief Richard Smith says the girl isn't likely to be charged.<br><br>Smith has seen a rise in sexting cases among area teenagers, but says he never expected to get a report like this from an elementary school.<br><br>"Strange, surprising and certainly unexpected for a third grader to do that video on a phone,” Smith said.&nbsp; “It was shocking when we first got the call."<br><br>Police notified the Department of Children's Services, which is now helping with the investigation.&nbsp; Police believe only four children, including the girl who made the recording saw the video and say it wasn't posted online.<br><br>Even though cases like these are rare for kids of such a young age, parents at the Portland Little League baseball fields, said it’s important to monitor your kids cell phone activity no matter how old they are.<br>&nbsp;<br>"You've got to set ground rules or things will get out of control,” said Kenneth Stafford, father of three.&nbsp; “Especially the way this world is now.”<br><br>Stafford says his kids got phones when they turned 12, and while they can be vital in an emergency, smart phones can also connect kids to strangers on facebook and access and entire world of websites.<br><br>"There's stuff on there they should not see,” Stafford said.&nbsp; “That's why you should monitor everything that they do on their cell phones if they do have cell phones."<br><br>The police investigation is on-going, pending the results of the DCS inquiry.<br>]]></description>

They replace Britney Spears and record producer Antonio "L.A." Reid.<br>&nbsp;&nbsp; It's a reunion for Rowland and Cowell, although American audiences might not know that. She served as a judge for a season on the more successful British version of the music show.<br>&nbsp;&nbsp; In a news release Monday Rubio told Cowell to "be careful what you wish for." She said she wondered if the notoriously cranky judge would be ready to handle her.<br>]]></description>
