Defense Team in Vandy Rape Case Plans to File for Dissmissal - Erika Lathon

NASHVILLE, Tenn. -The war of words continues to heat up between attorneys in the Vanderbilt Football rape case. On Tuesday we sat down with Deputy District Attorney, Tom Thurman to talk about information being leaked to the media. He says the leaks could be an ethics violation if a lawyer involved in the case is responsible. An attorney one of the four rape suspects, Brandon Vandenburg is firing back. Herbison says, "the controversial information did not come from this defendant. If it had it would have been first amendment protected. And even if it has some prejudicial effect, we have the first amendment rights and a right under the rules of professional conduct to respond to public information that is otherwise out there." Herbison says Vandenburg's legal team plans to file a motion to dismiss the case next week. The rape trial for Vandenburg and the other three defendants, Cory Batey, Jaborian McKenzie and Brandon Banks is scheduled for August.
